Terms of Use

Please read these Terms of Use (“Terms”) carefully before using this online payment portal (the “Portal”) operated by Smile Doctors LLC and its affiliated practices (collectively, the “Practice”). By accessing or using the Portal, you agree to be bound by these Terms. If you do not agree, do not use the Portal.

Acceptance of Terms

By using the Portal, you represent that you are at least 18 years of age and have the legal authority to make a payment on the account associated with your access credentials. Continued use of the Portal constitutes your acceptance of these Terms as they may be updated from time to time.

Authorized Use

The Portal is intended solely for patients and authorized parties making payments on legitimate orthodontic patient accounts held with a Smile Doctors–affiliated practice. You agree to use the Portal only for lawful purposes and only to make payments on accounts for which you are authorized. Any unauthorized use of the Portal is strictly prohibited.

Payment Authorization

By submitting a payment through the Portal, you authorize the Practice to charge the payment method you provide for the amount specified. You represent that you are an authorized user of the payment method submitted. Payments are processed by a third-party payment processor; the Practice does not store your full payment card or bank account details on its servers.

All payments are subject to verification and approval by the payment processor. The Practice reserves the right to refuse or reverse any payment that it believes to be unauthorized, fraudulent, or made in error.

Accuracy of Information

You are responsible for ensuring the accuracy of all information you submit through the Portal, including payment amounts and payment method details. The Practice is not liable for losses arising from incorrect information submitted by you.

Third-Party Payment Processing

Payments made through the Portal are processed by a third-party payment processor. By making a payment, you acknowledge that your payment information will be transmitted to and processed by that third party, subject to their terms and privacy policies. The Practice is not responsible for the acts or omissions of third-party processors.

No Warranty

The Portal is provided on an “as is” and “as available” basis without warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The Practice does not warrant that the Portal will be uninterrupted, error-free, or free of viruses or other harmful components.

Limitation of Liability

To the fullest extent permitted by applicable law, the Practice shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Portal, including but not limited to payment processing errors, service interruptions, or unauthorized access to your information. The Practice’s total liability for any claim arising from your use of the Portal shall not exceed the amount of the payment transaction at issue.

Privacy

Your use of the Portal is also governed by the Practice’s Notice of Privacy Practices, which is incorporated into these Terms by reference. Please review it carefully.

Changes to These Terms

The Practice reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of the Portal after any changes constitutes your acceptance of the revised Terms.
